Mortgage Foreclosure Surplus

If your home sold at a foreclosure auction for more than the debt and costs owed, money may be left over. This page explains what those funds are and how they may be claimed.

What mortgage foreclosure surplus funds are

When a home is sold at a mortgage foreclosure auction, the sale price is first used to pay off the loan balance and the costs of the sale. If the sale price is higher than what was owed, the extra amount is known as surplus funds, excess proceeds, or home equity funds. That money may belong to the former homeowner or other entitled parties, not the lender.

Why money may remain after a foreclosure sale

A foreclosure sale can bring in more than the amount still owed on the mortgage once the loan balance, interest, fees, and sale costs are accounted for. When that happens, the difference is not automatically kept by the lender. The remaining funds may be held for the person or parties who had an interest in the property.

Who may be eligible to claim the money

The former homeowner is often the first party entitled to any surplus. In some cases, heirs, beneficiaries, or other lienholders may also have a valid claim. Eligibility depends on the records tied to the property and the rules that apply where the sale took place.

Why rules and deadlines vary by state

Each state and county sets its own process for handling surplus funds, including who must be notified, how claims are filed, and how long interested parties have to come forward. Because these rules differ, the steps and timing for one property may not match another. Acting promptly helps avoid missing a filing window.
